Welcome to Flipper47 (“Flipper47,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our website at flipper47.com and our web application / PWA (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility & Accounts

• You must be at least 13 years old (or the age of digital consent in your country) to use the Service. If you are under the age of majority, you must have a parent or legal guardian’s permission.
• You’re responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. Notify us immediately if you suspect unauthorized access.

Sign-in: We use third-party identity providers (e.g., Google OAuth) to authenticate you. You authorize us to receive and store basic profile data from those providers as described in our Privacy Policy.

2. Subscriptions, Billing & Trials

• Some features require a paid subscription (“Subscription”). Plans are billed in advance on a recurring basis (e.g., monthly or yearly) until canceled.
• Payments are securely processed by our provider Lemon Squeezy. We don’t store full payment card details.
• You can manage or cancel your Subscription from your account billing page. Cancellations take effect at the end of the current billing period; access continues until then.
• Fees are non-refundable except where required by law. If a trial is offered, you must cancel before it ends to avoid charges.
• We may change prices or features; if we do, we’ll give reasonable notice for renewals.

Taxes and any applicable fees are your responsibility.

3. Acceptable Use

You agree not to:

• Violate applicable laws or rights of others.
• Upload illegal, infringing, or harmful content.
• Attempt to access accounts or data without authorization.
• Interfere with or disrupt the Service, reverse engineer, or scrape without permission.
• Circumvent rate limits, security controls, or payment requirements.

We may suspend or terminate access for violations of these Terms or to protect the Service or other users.

4. Content You Provide (“User Content”)

You retain ownership of content you submit (e.g., item photos, descriptions, hints). You grant Flipper47 a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, adapt, and display your User Content solely to operate, improve, and provide the Service (including quality assurance, moderation, analytics, and feature development). We may transform content as technically necessary (e.g., thumbnails, compression).

You represent that you have the necessary rights to submit the content and that it doesn’t violate laws or third-party rights.

Training & improvements. We may use anonymized and aggregated data derived from your usage to improve features and performance (e.g., pricing estimate accuracy, detection quality, global scan counters shown on the landing page). We do not sell your individual photos or use them for ads.

5. AI Estimates & No Financial Advice

Flipper47 uses AI to suggest categories, item identification, and resale value estimates. These are informational only and may be inaccurate due to market volatility or limited data. We do not provide financial, legal, or professional advice. You’re solely responsible for buying/selling decisions and for verifying facts before acting.

6. Third-Party Services

The Service integrates with third parties (e.g., Google for sign-in, Supabase for authentication/session management and data storage, Lemon Squeezy for billing). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party services we don’t control.

7. Beta/Experimental Features

From time to time, we may offer preview or beta features. They are provided as-is, may change or break without notice, and may be subject to additional terms or usage limits.

8. Intellectual Property

The Service, including our software, design, trademarks, and branding (including the Flipper47 name, logo, and mascot), is owned by Flipper47 and/or our licensors and is protected by copyright and other laws. Except as expressly permitted, you may not use our marks or copy, modify, or create derivative works of the Service.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how we use it, and your choices. We take reasonable measures to protect user data but cannot guarantee absolute security.

10. Service Availability & Changes

We may update, suspend, or discontinue the Service (or any part of it) at any time. We’ll try to avoid disruptive downtime, but availability is not guaranteed.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that estimates will be accurate.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIPPER47 AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. IN ALL CASES, OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID TO FLIPPER47 IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions don’t allow certain exclusions/limits; in those places, we limit liability to the maximum allowed.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access for any reason, including breach of these Terms. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations of liability, governing law) will survive.

14. Governing Law & Venue

These Terms are governed by the laws of Delaware, United States, without regard to conflict-of-laws rules. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for any dispute arising out of these Terms or the Service.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we’ll provide notice (e.g., by posting on the site or emailing you). The updated Terms are effective when posted unless we state otherwise. Your continued use of the Service after changes become effective means you accept them.
